SAN FRANCISCO WOMAN CONVICTED IN DOMESTIC VIOLENCE CASE

Binh Sam was convicted for domestic battery and assault.

San Francisco, CA – Today, San Francisco District Attorney Brooke Jenkins announced that her office secured a conviction of Binh Sam (40) after trial by jury for using force against her intimate partner.  She was convicted of domestic battery (PC 243(e)(1)), battery (PC 242), and assault (PC 240).

“The jury’s verdict delivers justice for the victim and holds Ms. Sam accountable for her actions,” said District Attorney Brooke Jenkins. “Intimate partner violence is unacceptable, and children must be protected from witnessing these types of situations.  My office will continue to advocate for victims of domestic violence to ensure that they are protected and receive resources to heal and move forward.”

On September 14, 2022, at about 7:00 PM, Binh Sam and her partner got into an argument about finances in their living room.  As the couple’s two minor children looked on, Ms. Sam threw a recycling bin at her partner’s head, poured a bottle of liquor on him, and pushed him, causing him to hit his head against the wall three times.  Finally, Ms. Sam ordered her minor daughter to strike her father.  Although Ms. Sam was grabbing and chasing her partner, he ultimately managed to leave the apartment and flee on foot to a local hospital. Hospital staff issued a domestic violence report to which SFPD officers responded.  Ms. Sam was arrested by San Francisco Police in her home in the Tenderloin neighborhood.

The case against Ms. Sam was successfully prosecuted by Assistant District Attorney Ross Garcia with assistance from Victim Advocate Melissa Curiel and Intern Emma Chan.  Prosecutors were able to develop a strong case against Ms. Sam based on the outstanding investigative work performed by the San Francisco Police Department’s Special Victim’s Unit.

“I am grateful to the jury for their careful consideration of the evidence; to our victim advocates for their steadfast commitment to victim safety; to the San Francisco Police Department for their thorough investigation; and to the victim for his bravery,” said Assistant District Attorney Ross Garcia.  “It was his compelling testimony that ensured Ms. Sam was held accountable for her actions.”

Ms. Sam faces one year in County Jail.  Sentencing is scheduled for August 31, 2023.

Alameda County DA Pamela Price Could Save Job If She Had That Kind Of Output

Alameda County District Attorney Pamela Price has not matched her San Francisco counterpart’s output of press releases since she took over for Nancy O’Malley, after winning the 2022 election over Terry Wiley. With the drum-beat of recall, Pamela Price has ignited her enemies into a frenzy, more by her public message than anything else. Pamela Price let’s one know that she is working for those who voted for her and against those who did not. By contrast, SFDA Brooke Jenkins doesn’t use the media to pick fights with people. But the SFDA does use it to point out problems with the system.
